You must be at least 18 years old, or the age of majority in your jurisdiction if it is higher, to use Noxelle. By using the Service, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

Noxelle contains adult-oriented creative tools. You are responsible for ensuring that accessing and using such tools is lawful where you live.

• You are responsible for keeping your login credentials secure and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• Notify us promptly at [email protected] if you suspect unauthorized use of your account.
• You may not share, sell, or transfer your account to anyone else.

Your use of the Service must comply with our Content Policy, which is incorporated into these Terms. You agree not to use Noxelle to create, upload, or distribute prohibited content, including content involving minors, non-consensual real-person likenesses, exploitation, or anything illegal.

You also agree not to misuse the Service, including by attempting to bypass safety systems, reverse engineer the tools, scrape or overload our systems, resell access, or use the Service to build a competing product.

You retain ownership of the original content you create with Noxelle, to the extent such content is protectable and lawfully created. You are solely responsible for your inputs, uploads, and generated outputs, and for ensuring you have all necessary rights and consents.

You grant Noxelle a limited license to host, store, process, and display your content as needed to operate the Service, provide support, ensure safety, and comply with the law. You represent that your content does not infringe the rights of others or violate any law.

Because of how AI models work, outputs may not be unique, and similar content may be generated for other users. We make no claim of ownership over your prompts, but we cannot guarantee that any output is exclusive to you or eligible for legal protection.

• Some features require credits or a paid plan. Pricing and credit costs are shown before you generate and may change over time.
• Credits are a license to use the Service, not stored value or currency, and have no cash value.
• Payments are processed by third-party providers; by purchasing, you also agree to their terms.
• Except where required by law, payments and credits are non-refundable, including for unused credits and for outputs you are not satisfied with.
• We may change, suspend, or discontinue plans, pricing, or features at any time.

The Service, including its software, design, branding, and the content we provide, is owned by Noxelle LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, lawful, adult creative use, subject to these Terms.

You may not copy, modify, distribute, or create derivative works from the Service itself without our permission.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

AI-generated outputs may be inaccurate, unexpected, or unsuitable for your needs. You are responsible for reviewing and deciding how to use any output. We do not guarantee uninterrupted, error-free, or secure operation.

To the maximum extent permitted by law, Noxelle LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid Noxelle in the three months before the claim or one hundred US dollars (USD 100).

You agree to indemnify and hold harmless Noxelle LLC from any claims, damages, losses, and expenses, including reasonable legal fees, arising from your content, your use of the Service, or your violation of these Terms or the law.

We may suspend or terminate your access at any time if you violate these Terms, our Content Policy, or the law, or if we need to protect the Service or other users. You may stop using the Service at any time.

Upon termination, your right to use the Service ends. Sections that by their nature should survive, such as content rights, disclaimers, limitation of liability, and indemnification, will continue to apply.

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California, unless applicable law requires otherwise.

We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date. Material changes take effect when posted, and your continued use of the Service means you accept the revised Terms.
